As of August 17, 2024, the real estate industry experienced significant changes that will affect the way buyers and sellers approach the purchase or sale of a home. These changes include the mandatory Buyer Broker Agreements and a shift in how buyer-broker compensation is handled.
Here’s what you need to know about these changes and how they will impact your real estate transactions.
A Buyer Broker Agreement formalizes the arrangement between a homebuyer and a real estate broker, outlining responsibilities and compensation. It details the broker’s services, fees, and the terms of their representation. Starting from August 17, 2024, it will be mandatory for homebuyers to enter into this agreement before a broker can show them any properties.
Previously, Buyer Broker Agreements were utilized as an optional layer to a Realtor’s business process but were not universally required. The new regulation ensures that all homebuyers will have a clear understanding of their broker’s services and compensation from the beginning. This shift aims to protect buyers and enhance transparency in the home-buying process.
With the new rules, buyer-broker compensation will no longer be displayed in the Multiple Listing Service (MLS). As a result, homebuyers may not immediately find out if or how much of their broker’s fee will be paid by the seller.
Buyers will now need to negotiate broker compensation as part of the purchase agreement. They can request the seller to cover part or all of the broker’s fee through the sale proceeds or pay the broker directly.

Sellers can choose to pay the buyer’s broker’s commission as part of the sale agreement. This can be arranged either upfront or negotiated as part of the sale terms. Offering to fund some or all of the buyer’s broker compensation can be advantageous, as it may attract more buyers and facilitate a smoother transaction.
With the change in how buyer-broker compensation is handled, sellers should anticipate receiving offers that include requests for compensation funding. It will be the listing broker’s responsibility to help sellers evaluate these offers and negotiate the best terms for their property.
